Terms of Service

1. Acceptance of Terms

By creating an account or using AiBuddy (the "Service"), operated by PnG Solutions (Greece), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. The Service

AiBuddy is an AI-powered social media management platform that helps you plan, generate, schedule, and publish content on Facebook Pages, Instagram Business accounts, and LinkedIn profiles, using AI models to assist with copy and imagery.

3. Eligibility

• You must be at least 16 years old (or the legal age of digital consent in your country)
• You must have the legal right to publish content to the social media accounts you connect
• Business use: you must have authority to bind the entity you represent

4. Account & Security

• You are responsible for maintaining the confidentiality of your credentials
• You are responsible for all activity under your account
• Notify us immediately at security@aibuddy.gr of unauthorized use
• We reserve the right to suspend accounts on suspicion of abuse, fraud, or ToS violation

5. Free Trial & Subscriptions

• New accounts receive a 14-day free trial with access to all modules
• After trial, continued use of paid features requires an active subscription or credit purchase
• Subscriptions renew automatically until cancelled from your account settings
• Prices are shown in EUR excluding VAT unless otherwise stated
• Payments are processed by Stripe; we do not store card details

6. Credits

• Certain features (AI generation, image creation, voice) consume credits
• Credit prices per action are shown in-app and may be updated with 14 days' notice
• Purchased credit packs do not expire
• Subscription-included credits reset monthly and do not roll over
• Credits are non-refundable except where required by law

7. Your content

You retain ownership of everything you upload or generate through AiBuddy. By using the Service, you grant us a limited, non-exclusive licence to store, process, and transmit your content only insofar as is necessary to provide the Service (including publishing on your behalf to connected social accounts and generating AI variations you request).

You are solely responsible for content you publish. You represent that:

• You own or have licenced all rights necessary
• Your content does not infringe third-party rights (copyright, trademarks, privacy)
• Your content complies with the rules of the target social platform (Meta, LinkedIn) and applicable law

8. AI-generated content

• AI outputs are suggestions — you are responsible for reviewing them before publishing
• AI models may produce inaccurate, offensive, or biased content; you agree to review outputs
• AiBuddy does not warrant the truthfulness of AI-generated text or the originality of AI-generated images
• Some jurisdictions require disclosure of AI-generated content; you are responsible for compliance

9. Acceptable Use

You agree NOT to use AiBuddy to:

• Publish spam, harassment, hate speech, or illegal content
• Impersonate individuals or organizations
• Publish sexually explicit or violent material
• Attempt to circumvent rate limits, credit costs, or authentication
• Reverse-engineer, decompile, or scrape the Service
• Use the Service to publish political disinformation or election interference material

Violations may result in immediate account termination without refund.

10. Third-party platforms

AiBuddy publishes to Facebook, Instagram, and LinkedIn on your behalf via each platform's official API. Your use of those platforms remains subject to their respective terms:

• Facebook / Instagram: Meta Terms of Service
• LinkedIn: LinkedIn User Agreement

We are not responsible for changes to those platforms' APIs, policies, or availability that may affect the Service.

11. Availability

We target 99.5% uptime but do not guarantee uninterrupted access. Scheduled maintenance windows are notified in-app.

12. Termination

• You may cancel at any time from your account settings
• We may suspend or terminate accounts for material breach of these Terms
• Upon termination, we delete your data within 90 days (see Privacy Policy)
• Sections 7, 8, 13, 14, and 15 survive termination

13. Warranty disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

14. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill.

Nothing in these Terms excludes liability for death, personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Greek/EU law.

15. Governing law & jurisdiction

These Terms are governed by the laws of Greece. Disputes shall be brought exclusively before the competent courts of Athens, Greece.

EU consumers retain the protections of mandatory local consumer law and may lodge complaints via the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Changes to Terms

We may update these Terms. Material changes will be notified by email at least 14 days before taking effect. Continued use after changes take effect constitutes acceptance.
